Terms of Service
These terms are an agreement between you and Fossa Visuals LLC, which operates Just Holler. By creating an account or using Just Holler, you agree to them. If you're signing up for a business, you confirm you can accept these terms for that business.
What Just Holler does
Just Holler gives your business a phone number answered by an AI assistant when you can't pick up. It can answer questions using the information you provide, take messages, book appointments on your Just Holler calendar, transfer urgent calls to you, and send you a summary of each call by text and email.
Text message (SMS) terms
Just Holler Call Alerts
- What you'll get: automated texts to the cell number on your account with summaries of calls your assistant answered, voicemails, booked appointments, urgent-call alerts, and links to the call details. If you book an appointment by phone with a business that uses Just Holler, you can also get a text confirming it.
- How you sign up: by checking the box that agrees to receive texts during setup or in Settings. The box is never pre-checked. These texts are part of the Just Holler service, and you can stop them anytime by replying STOP. The line is automated, so please don't reply to it. Callers who book an appointment are asked on the call whether they want a text confirmation, and get one only if they say yes. See how the opt-in works.
- How often: message frequency varies with your call volume, usually one text per call or voicemail.
- Cost: message and data rates may apply. Just Holler doesn't charge for texts.
- To stop: reply STOP to any message (account owners can also turn off text summaries in Settings). You'll get one confirmation text and no more texts after that. Reply START to turn them back on.
- Help: reply HELP to any message, or email fossavisuals@gmail.com.
- Carriers are not liable for delayed or undelivered messages.
- Your phone number and consent are never shared with third parties for marketing. See our Privacy Policy.
Your account
- Give us accurate information, including a cell number you own or are authorized to use, and keep it up to date.
- Keep your password safe. You're responsible for activity on your account.
- You must be at least 18 and using Just Holler for a business.
Free trial, billing, and cancellation
- New accounts start with a free trial, with no card required. If you add a card before the trial ends, your subscription starts when the trial ends and renews monthly until you cancel. If you don't, the subscription ends with the trial and your assistant stops answering.
- Payments are processed by Stripe. Prices are shown on our website and in the app, and taxes may apply.
- You can cancel anytime from Billing in your dashboard. Your plan stays active until the end of the period you've paid for. We don't give refunds for partial months unless the law requires it.
- Each plan includes a number of assistant-answered calls a month. Once they're used, calls ring your cell and go to voicemail, at no extra charge, unless you choose in Billing to keep your assistant answering. Then each extra call the assistant answers and the caller speaks on is $0.90, added to your next invoice (free during the trial).
- If a payment fails or your subscription ends, calls to your Just Holler number forward straight to your cell instead of the assistant.
- We'll give you at least 30 days' notice before changing the price of your plan.
Referral program
- If you refer a new business with your link or code and it pays its first invoice (after the free trial), we add a credit of $100 (or the amount of that first payment, if it was less) to your account, applied to your Just Holler invoices. The credit is added about 7 days after that payment clears.
- We credit up to 3 referrals per customer per month; any others roll into the next month. A referred business gets 15% off its first 3 months (or a founding offer, if it is bigger; the two don't combine).
- Credits have no cash value, can't be transferred, and end if your account is canceled. Referring yourself or your own other business doesn't count, and we may withhold or take back a credit for refunded or disputed payments or misuse of the program.
- Don't spam. Share your link with people you know.
Your phone number
The Just Holler number assigned to your account is provided through our phone carrier, Twilio. You can use it while your account is active. If your account is closed, we may release the number after a reasonable period, so tell your customers about any number change before you cancel.
Your responsibilities
- Call recording. If you turn on recording, you can also have the assistant tell callers the call may be recorded. You're responsible for following the recording and consent laws that apply to your calls.
- Your information. You're responsible for the services, prices, hours, and answers you give the assistant, and for keeping them accurate.
- Acceptable use. Don't use Just Holler for anything illegal, for robocalls, spam, or harassment, to mislead callers, or to try to break, overload, or get around the service's security.
AI and service limits
The assistant is AI and can misunderstand callers or make mistakes. Always check important details, like addresses, times, and urgent requests, in the call summary, transcript, or recording. Just Holler is not an emergency service and doesn't replace calling 911.
We work hard to keep Just Holler running, including forwarding calls to your cell if the assistant is unavailable, but phone networks and internet services can fail. We can't promise the service will be uninterrupted or error-free.
Your data
You own your business information and call records. You let us use them only to provide and improve Just Holler, as described in our Privacy Policy.
Suspension and termination
You can close your account at any time. We may suspend or close accounts that break these terms, don't pay, or put callers, our carriers, or the service at risk. When possible, we'll warn you first.
Disclaimers and limitation of liability
Just Holler is provided “as is.” To the extent the law allows, we disclaim implied warranties, including fitness for a particular purpose, and we aren't liable for lost profits, lost jobs, missed calls, or indirect or consequential damages. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
General
- These terms are governed by the laws of the State of Texas. Disputes will be handled in the state or federal courts in Williamson County, Texas.
- We may update these terms. If changes are significant, we'll tell you by email or in the app before they take effect. Using Just Holler after that means you accept the new terms.
- If any part of these terms can't be enforced, the rest still applies.
